Terms of service
The proposed agreement for using Tiny Torque My Garage.
Review draft — not yet effective. This document describes the proposed terms for the planned service. Production signup, paid subscriptions and the operational commitments below require launch verification and approval. Reading this draft does not enter you into a subscription.
Tiny Torque My Garage is a collection management service operated by TINY TORQUE, LLC (“Tiny Torque”, “we”, “us”). These terms govern the app at app.tinytorque.com and authorized previews at app-dev.tinytorque.com. Our business contact is support@tinytorque.com, and our published business address is 21 Chestnut Street, Quincy, MA 02169, United States.
The Tiny Torque merchandise shop at tinytorque.com is a separate service from My Garage. Purchases of physical products remain subject to the shop’s applicable terms. A My Garage subscription does not buy models, shipping, insurance, appraisal or a shop subscription.
1. The agreement and your consumer rights
When released, these terms and the Refunds and Cancellation policy form the agreement you expressly accept when creating an account or purchasing a subscription. The Privacy Policy explains our handling of personal information; accepting these terms is not blanket consent to optional data uses.
You keep all rights that applicable law does not permit us to exclude, including consumer guarantees, cooling-off rights, rights to remedies for defective digital services, privacy rights and access to courts or regulators. If a provision conflicts with those rights, those rights prevail. A more favorable specific offer or mandatory local rule takes priority over a general restriction in these terms.
2. Who can have an account
Account holders must be at least 18 and old enough to enter a binding contract where they live. My Garage is intended for adult collectors. We do not offer child accounts or accounts operated by children with a parent’s permission in this version.
Use your own account and provide accurate account and billing information. Keep your sign-in methods secure, keep your contact email current and promptly report suspected unauthorized access to support@tinytorque.com. You are responsible for activity you authorize, but these terms do not make you automatically responsible for unauthorized activity caused by our failure to meet our obligations.
We intend to make the service available internationally, subject to applicable law, lawful payment availability and any restrictions displayed before signup or checkout. Availability in a country does not remove that country’s mandatory protections. Do not evade lawful access restrictions or impersonate another person.
3. What My Garage provides
My Garage is designed to record individual physical collectibles, organize groups and preserve collection history. Catalog information, your private edits, purchase history, personal valuations and any future published collection are distinct. A catalog entry, imported order or recorded purchase does not establish legal title, authenticity, delivery, insurance value or ownership of an item.
Features identified as planned, previews or examples are not promises of current availability. Public garages, collector messages, connected shop history, collector price contributions and market estimates must be separately released before they can be used. The current development version does not enable live billing or production community features.
Any guide, identification suggestion or estimate is informational. Purchase price is not resale value. We do not guarantee catalog completeness, market prices, investment returns or the accuracy of information supplied by another collector. We remain responsible for meeting applicable obligations concerning the service itself.
4. Free, Plus and the trial
The proposed Free plan allows 250 active physical copies, 10 collection groups and 250 MB of user media. Garage Plus allows unlimited copies and groups and 2 GB of user media. Storage uses decimal units: 250 MB is 250,000,000 bytes and 2 GB is 2,000,000,000 bytes. File restrictions and security controls apply to both plans. “Unlimited” copies and groups means no numerical plan quota for ordinary personal collection use; it does not authorize automated resource abuse or unrelated file hosting.
Each physical copy counts individually, including duplicate models. An intact boxed set counts as one physical copy until explicitly split. Wishlist entries and order history do not by themselves count as owned copies. The displayed usage information explains the applicable limits.
A 30-day Plus trial is offered once per eligible verified account holder without a payment card. It does not enroll you in a paid subscription, charge you at expiry or authorize us to charge a payment method you used at the merchandise shop. You must separately complete checkout to purchase Plus. Creating replacement accounts to obtain repeated trials is not permitted.
When a trial or paid plan ends, your account returns to Free. Downgrading alone does not delete, hide or unpublish your collection, remove its history or change your privacy choices. Existing data remains available to read, edit, export and remove; additions that would exceed a Free quota are paused until usage permits them or you upgrade. Downgrading is different from requesting account deletion.
5. Paid subscriptions and renewals
The proposed standard price is US$3.99 per month or US$34.99 per year. The annual amount is charged upfront for the year, not in monthly installments. The binding amount, currency, taxes, billing interval, renewal date and any promotion must be shown before you authorize payment. Your bank may apply its own currency conversion or fees.
A paid subscription renews for the same billing interval until you cancel. You authorize only the recurring charges clearly disclosed and accepted at checkout. There is no paid commitment from starting the no-card trial. We send a confirmation that you can keep, charge receipts and applicable renewal notices. Billing is handled through Stripe separately from the Tiny Torque merchandise shop.
You may stop renewal at any time using the online billing controls or by emailing support@tinytorque.com. Cancellation does not require a phone call, explanation or acceptance of an offer. Your confirmation states when Plus access ends. The Refunds and Cancellation policy explains refunds, immediate withdrawal and unused annual time.
If payment fails, we notify you and provide a way to update it. A recoverable overdue payment may receive a grace period of up to three days; this does not extend the agreed billing period or create a new charge without authorization. If payment is not resolved, Plus ends and the lossless Free downgrade applies. You may still dispute an incorrect charge.
We do not increase the price of an already paid period. A proposed price increase will be communicated at least 30 days before it can take effect, with the new amount, date and cancellation method. Where affirmative agreement is required, we obtain it before charging the new price. Existing promotional terms govern their stated duration; a development price is not a promise of lifetime pricing.
6. Your collection and content
You retain your rights in the content you provide. You give us a limited, nonexclusive permission to host, store, process, copy and display that content only as needed to provide your selected service, secure it, make backups and follow your instructions. This permission does not authorize advertising with your private collection, selling your content or training a general-purpose AI model on it.
You must have the rights needed to upload photos, text and files and to direct any sharing. Do not upload confidential information about other people without a lawful basis. Keep unnecessary identity documents, full payment card details, passwords and sensitive personal information out of collection notes and uploads.
If public sharing is released and you choose it, permission to display your selected safe fields and permitted photos extends to the audience you chose. Private costs, receipts, purchase locations, storage locations, order references, private notes and messages do not become public through that setting. You can revoke publication. Copies already made independently by other people may be beyond our control.
Permission ends when your content is removed, except for limited backup, legal or dispute retention explained in the Privacy Policy. This does not transfer your ownership to us. A suggestion or support message also does not give us ownership of your collection.
7. Acceptable use and future community features
Use the service lawfully and respect other collectors. Prohibited conduct includes fraud, impersonation, harassment, threats, exploitation, unlawful discrimination, disclosure of someone else’s private information, infringement, malicious files, unauthorized access, evasion of security or quotas and spam. Do not use My Garage for unlawful transactions or to distribute illegal content.
You may export your own data and use permitted accessibility tools. Do not scrape private accounts, bypass access controls, copy protected catalog content in bulk without permission, or operate automated traffic that materially disrupts the service. Ordinary public search indexing remains subject to our publication and access controls.
If messaging is released, a request is not permission for an ongoing conversation. Sending depends on the recipient’s acceptance, current settings, blocks and account status. Messaging will initially support text only. My Garage is not a marketplace, escrow provider or transaction intermediary; collector communications do not create buyer or seller protection.
Report content, harassment or infringement to support@tinytorque.com with enough information to locate and assess it. Do not send unrelated private records. We may request evidence or clarification and will consider corrections and appeals. A report does not give staff unrestricted access to private collections or inboxes.
8. Restrictions, suspension and appeals
We may restrict content or access where reasonably necessary to investigate credible abuse, protect people or systems, comply with law or address a material breach. We use measures proportionate to the issue and explain the reason and available appeal route unless doing so is prohibited or would compromise safety or an investigation. Urgent protective action may precede notice.
You may appeal by emailing support@tinytorque.com. We review relevant evidence and correct mistakes. Where safe and lawful, we provide a reasonable opportunity to retrieve your data. We do not use suspension to avoid a valid refund, consumer remedy or privacy request. Any withheld refund must have a lawful, explained basis; suspension is not automatic forfeiture of all prepaid fees.
9. Availability, changes and closure
We will provide the service with reasonable care and skill. Maintenance, incidents or third-party failures can interrupt access; we do not promise uninterrupted operation or a particular uptime percentage. The Refunds and Cancellation policy provides remedies for unavailable or defective paid service, without limiting mandatory remedies.
We may improve features and correct errors. If we materially reduce a paid feature during a prepaid term, we will give reasonable notice and an appropriate remedy, including a proportional refund when you end the affected service. We will not use a general change clause to remove the essential value of a paid plan without a remedy.
If we discontinue My Garage, we intend to give at least 30 days’ notice when reasonably possible, stop future renewals, provide an export opportunity and refund unused prepaid service. An urgent legal or safety requirement may prevent advance notice, but does not erase refund or data rights. Keep a separate copy of records you need independently of the app.
10. Responsibility and limits
We are responsible for losses caused by our breach of these terms or failure to exercise the care required by applicable law, subject to the rules of that law. We do not exclude liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or any liability or remedy that cannot legally be excluded.
The service is intended for personal collection management. To the extent permitted by law, we do not accept liability for business profits or commercial opportunities that were not reasonably foreseeable when the agreement was made. This does not remove responsibility for foreseeable personal losses, applicable data protection duties or mandatory consumer remedies. There is no blanket waiver of liability for loss of your data.
11. Complaints and disputes
Please contact support@tinytorque.com with a description of the issue and the result you seek. We aim to acknowledge complaints within two business days and provide a substantive response within 14 calendar days, or explain what further investigation is needed. Contacting us first is encouraged but is not a condition of exercising statutory rights.
Applicable law determines the governing law and the courts that may hear a dispute. Nothing in these terms deprives a consumer of the mandatory protections of their home jurisdiction or the right to use a court or regulator available under law. These terms impose no mandatory arbitration, class-action waiver, exclusive foreign forum or shortened statutory claim deadline.
12. Changes to these terms
We will identify each version and its effective date. Material changes will be explained and notified at least 30 days before taking effect, except where a shorter period is necessary to comply with law or address an urgent security issue. Changes do not retroactively remove accrued rights or change completed transactions.
We will obtain renewed agreement when the law or the nature of a change requires it. New optional processing requires its own appropriate choice; continued use does not silently publish your garage, enroll you in price contributions or permit new marketing. If a material adverse change affects a prepaid subscription and you do not accept it, you may end the affected service and receive an appropriate refund of unused prepaid time.
If a provision is unenforceable, the remaining provisions continue where the agreement can reasonably operate without it. A delay in enforcing a right is not a waiver. Any transfer of this agreement must preserve your rights and cannot reduce the protections you accepted.
